When disputes arise between insurance companies or between individuals and insurance companies regarding whether coverage applies to a claim and/or the amount of coverage that applies to a claim, litigation may be required to resolve the dispute. Although the focus of our practice is on automobile accident litigation, we have the handled insurance coverage disputes involving homeowners’ insurance contracts, general liability insurance contracts, and life insurance contracts in addition to automobile insurance contracts. In recent years, many of the insurance coverage disputes we have handled have involved uninsured and underinsured motorist coverage, which is coverage that applies when a person is injured due to the negligence of a person or entity that either has no insurance or limits of insurance coverage that are less than the coverage available to the injured person under his or her own insurance policy or policies.
It is also possible for uninsured or underinsured motorist coverage to be available to an injured person under the policy of another person or entity, such as the policy insuring the vehicle the injured person was occupying at the time of an automobile accident.
